929.10 TESTING AND ANALYSES.
   (a)   Industrial wastes or other wastewaters deemed to be significant by the Administrator discharged into the public sewer shall be subject to periodic inspections as deemed appropriate by the Administrator to determine the character and concentration of said wastes. The user shall be responsible for the collection and testing of the aforementioned samples.
   (b)   Samples shall be collected in such a manner as to be representative of the composition of the wastes. The sampling shall be accomplished by the use of automatic sampling equipment capable of collecting composite samples. The Administrator may require the user to install monitoring equipment as necessary. The user shall maintain specified equipment at all times in a safe and proper operating condition at the users expense. All devices shall be calibrated each calendar year and a copy of the certification shall be made to the Village upon request.
   (c)   All measurements, tests, and analyses of the characteristics of wastes to which reference is made in this Ordinance shall be determined in accordance with "40 CFR 136", unless such standards conflict with regulations promulgated by the EPA under 40 CFR Part 136, in which case the EPA regulations shall govern. Sampling methods, location, times, duration, and frequencies shall be determined on an individual basis, subject to approval by the Administrator.
   (d)   Laboratory procedures used in the examination of industrial wastes shall be those set forth in "40 CFR 136". Alternative methods for analysis of certain industrial wastes may be used subject to mutual agreement between the Administrator and the user.
   (e)   Determination of the character and concentration of the industrial wastes shall be determined as prescribed by Section 929.07(c) (1).
   (f)   The results of the analysis of the samples collected by the Village and any independent sampling by the user shall be compared using the same testing procedures as outlined in "40 CFR 136".
   (g)   When required by the Administrator, a user shall construct and maintain one or more control manholes or access points to facilitate observation, measurement, and sampling of the user's wastes, including sanitary wastewater. The user shall be allowed a reasonable period of time to construct said manholes or access points, not to exceed three (3) months. Control manholes or access points shall be located and built in a manner acceptable to the Administrator. Any measuring devices to be permanently installed shall be of a type acceptable to the Administrator. Control manholes, access points, and related equipment shall be installed by the user at the user's expense, and shall be maintained by the user in a safe condition, accessible and in proper operating order at all times. Plans for the installation of such facilities shall be approved by the Administrator prior to the beginning of construction.
