(a) Volume of Wastewater.
(1) Sanitary sewer charges shall be determined by applying a unit charge to a volume of wastewater flow from each user. Said volume shall be that which is recorded on the meters used to measure water delivered to the user from the Village water system or, for persons not connected to the Village water system, from water sources other than the Village water system.
(2) If the user is supplied with unmetered water from a source other than the Village water system or a substantial volume of water is supplied to the user but is not discharged to the wastewater treatment works, the volume of wastewater flow shall be determined by a meter installed to measure wastewater discharged, or by other means approved by the Administrator. In lieu of a wastewater meter, an industrial, commercial, or institutional/governmental user may install a separate water meter to measure the volume of water supplied to said user but not discharged to the wastewater treatment works, provided that a water meter is available to measure the total flow and provided that the Administrator approves of same in writing and is satisfied that the water measured by said separate meter will not be discharged to the wastewater treatment works.
(3) If a user elects to install a meter to register the exact volume of wastewater flow, the volume to be charged for shall be that which is recorded on the wastewater meter.
(4) Wastewater meters shall be approved by the Village, and shall be installed and maintained at the user's expense. The Village may remove and test a wastewater meter at any time which in the opinion of the Administrator is registering incorrectly, without the consent of the user. If the meter is found to be registering outside of the accuracy of the specifications published for same, the user shall bear the cost of removal, shipping, testing, repair, and replacement. If the meter is found to be registering within the accuracy of the specifications published for same, the Village shall bear the cost of removal, shipping, testing, repair, and replacement. During the period the meter is not in service, the volume of wastewater flow shall be determined by a means selected by the Administrator.
(b) Sewer User Charges.
(1) Until January 1, 2018, for premises located within the corporate limits of the Village, based on water used quarterly:
A. There shall be a minimum charge of thirty dollars ($30.00) for the consumption up to and including the first 5,000 gallons.
B. From 5,001 gallons usage, and any consumption thereafter, the rate shall be two dollars and twenty five cents ($2.25) per 1,000 gallons used, and any part thereof;
(2) Schedule of Sewer Rates-1/1/2018 - 12/31/2019. Beginning January 1, 2018 and continuing through December 31, 2019, for premises located within the corporate limits of the Village, based on water used quarterly:
A. There shall be a minimum charge of thirty dollars ($30.00) for the consumption up to and including the first 5,000 gallons.
B. From 5,001 gallons usage, and any consumption thereafter, the rate shall be two dollars and thirty cents ($2.30) per 1,000 gallons used, and any part thereof;
(3) Schedule of Sewer Rates-1/1/2020 - 12/31/2021. Beginning January 1, 2020 and continuing through December 31, 2021, for premises located within the corporate limits of the Village, based on water used quarterly:
A. There shall be a minimum charge of thirty five dollars ($35.00) for the consumption up to and including the first 5,000 gallons.
B. From 5,001 gallons usage, and any consumption thereafter, the rate shall be two dollars and thirty cents ($2.30) per 1,000 gallons used, and any part thereof;
(4) Schedule of Sewer Rates-1/1/2022 - 12/31/2023. Beginning January 1, 2022 and continuing through December 31, 2023, for premises located within the corporate limits of the Village, based on water used quarterly:
A. There shall be a minimum charge of thirty five dollars ($35.00) for the consumption up to and including the first 5,000 gallons.
B. From 5,001 gallons usage, and any consumption thereafter, the rate shall be two dollars and thirty five cents ($2.35) per 1,000 gallons used, and any part thereof;
(5) Schedule of Sewer Rates 1/1/2024 - 12/31/2025. Beginning January 1, 2024 and continuing through December 31, 2025, for premises located within the corporate limits of the Village, based on water used quarterly:
A. There shall be a minimum charge of thirty five dollars ($35.00) for the consumption up to and including the first 5,000 gallons.
B. From 5,001 gallons usage, and any consumption thereafter, the rate shall be two dollars and forty cents ($2.40) per 1,000 gallons used, and any part thereof;
(6) Schedule of Sewer Rates 1/1/2026 - 12/31/2027. Beginning January 1, 2026 and continuing through December 31, 2027, for premises located within the corporate limits of the Village, based on water used quarterly:
A. There shall be a minimum charge of forty dollars ($40.00) for the consumption up to and including the first 5,000 gallons.
B. From 5,001 gallons usage, and any consumption thereafter, the rate shall be two dollars and forty cents ($2.40) per 1,000 gallons used, and any part thereof. (Res. 2016-41. Passed 1-9-17.)
(c) Extra Strength Surcharges.
(1) For purposes of determining extra strength surcharges, the Village shall make periodic suspended solids and CBOD analyses and flow determinations at such establishments deemed necessary by the Village for high strength surcharge testing. Samples shall be composited over twenty-four hours during a regular operating day, unless the intermittent character of the establishment's output requires longer test periods. All costs associated with the testing procedure, including but not limited to analytical costs, labor, and equipment rental, shall be paid by the establishment. If the proprietor of any such establishment so requests, additional measurements and analysis shall be made by the Village at the proprietor's expense to be charged for as follows:
Sixty-five dollars ($65.00) per composite sample analysis or other specified costs as supplied by an outside laboratory
(2) At the request of the Village, the proprietor of any establishment producing industrial waste or other wastes deemed to be significant by the Administrator shall install, within sixty (60) days of the Village request, at his own cost, a suitable manhole in the establishment's sewer lateral for the use of the Village. The proprietor of the establishment shall also reimburse the Village, within 60 days of sampler installation, the cost of a Village-supplied sampler and appurtenances.
(3) Surcharge per pound of CBOD in excess of normal = $ 0.35*
(4) Surcharge per pound of suspended solids in excess of normal = $ 0.25*
(5) Pounds of CBOD per billing period subject to surcharge equals the user's average concentration of CBOD in milligrams per liter that exceeds the normal concentrations times the volume of wastewater discharged by the user per billing period (in 1,000 gallon increments), times 0.00834.
(6) Pounds of suspended solids per billing period subject to surcharge equals the user's average concentration of suspended solids in milligrams per liter that exceeds the normal concentrations, times the volume of wastewater discharged by the user per billing period (in 1,000 gallon increments), times 0.00834.
(7) Surcharges shall be computed by multiplying the pounds of CBOD by the surcharge per pound; multiplying the pounds of suspended solids by the surcharge per pound; and adding both figures. Provided however, if the CBOD is above 1,000 mg/l the charge shall be .50/lb.
(8) Surcharges may be established by the Village for other pollutants which are permitted by the Village to be discharged to the wastewater treatment works, whether after or without pretreatment. Provided however, if the TSS is above 1,100 mg/l the charge shall be .40/lb of TSS.
(9) Surcharges shall be billed at the same times as user charges.
* The extra strength surcharges for (3) and (4) above shall automatically increase by $.02 every two (2) years with the first of said increases taking effect on January 1, 2012.

(d) Capital Improvement Fund.
(1) All users shall be charged an additional amount for capital improvements as provided below:
Classification Charge Residential $22.50 per unit per quarter * Commercial $67.50 per unit per quarter Industrial $157.50 per unit per quarter |
* Commercial accounts with 15,000 gallons or less in water usage will be charged the residential capital improvement fund fee.
(2) Definitions. The following terms shall have the following meanings, as used in subsection (d), and shall be classified based on the primary use of the property.
A. “Residential": The classification of the type of user for the purposes of implementing a capital improvement fund fee. A utility account classified as residential means any building or portion thereof which is designed or used for residential purposes, including nursing homes, and assisted living communities but not including a cabin, hotel, motel, rooming house, or other such accommodation used for transient occupancy.
B. "Commercial": The classification of the type of user for the purposes of implementing a capital improvement fund fee. A utility account classified as commercial means any activity which renders services, wholesale sales, or retail sales but not including manufacturing of goods.
C. "Industrial": The classification of the type of user for the purposes of implementing a capital improvement fund fee. A utility account where manufacturing of goods is the primary business.
D. "Unit": The number of capital improvement fund fees charged per meter. For the purpose of nursing homes and assisted living communities, ten (10) beds will equal one (1) unit and the beds will be rounded down to the nearest unit.
E. "Meter": The device that measures the water consumption.
F. " Capital Improvement Fund Fee ": A fee levied on all users of water and sewer services provided by the Village for enhancement of the water treatment plant and system and the sewer treatment plant and system.
(3) The fees collected shall be placed one-half (1/2) in the Water R&I Fund and one-half (1/2) in the Sewer R&I Fund.
