(A) The city, on recommendation of the Tree Advisory Board, shall have the right to remove or cause the removal of any dead or diseased trees, tree roots, shrubs or bushes on private property within the city when the trees constitute a hazard to life or property or harbor insects or disease which constitute a potential threat to other trees within the city.
(B) The city, on recommendation of the Tree Advisory Board, will notify in writing the owners of the trees. Removal shall be done by the owners at their own expense within 30 days after the date of notice and shall include removing the stump and leveling the ground in the area of the stump. The notice provided in this section may contain the same statements as provided in § 95.08(B), and if containing the statements, may be enforced pursuant to § 95.08.
(C) In the event of failure of owners to comply with these provisions, the city shall have the authority to remove the trees. The city shall then direct that the cost of removal be billed to the property owner.
(D) Any person who removes a tree on the public right-of-way shall replace the removed tree in accordance with the requirements set forth in § 95.05. This requirement may be waived by the Tree Advisory Board where replacement would be inappropriate.
(E) Tree planting for new development (subdivision) shall be done in accordance with the Versailles, Midway and Woodford County subdivision regulations.
