§ 95.08 ENFORCEMENT OF PROPERTY OWNER'S OBLIGATIONS; LIENS.
   (A)   The obligation of the property owner as set forth in this chapter may be enforced by this section in addition to any other enforcement mechanism or penalty provided by this chapter or other law.
   (B)   In the event the Tree Advisory Board determines that a property owner has an obligation under this chapter, then it may recommend in writing to the City Council the action which the property owner must take in order to comply with this chapter and the specific section of this chapter on which it relies. The City Council, if it approves the recommendation, shall notify the property owner in writing of the following:
      (1)   The action which the property owner must take in order to comply with this chapter;
      (2)   The specific section of this chapter which requires that the action be taken by the property owner;
      (3)   The timeframe within which the action must be taken, which may not be less than 30 days from the date of this notice;
      (4)   That the property owner may appeal the Tree Advisory Board's recommendation by submitting a written statement objecting to the recommendation within 30 days from the date of the notice; and
      (5)   That if the recommended action is not taken, then the city may have the action performed and file a lien against the owner's property for its costs incurred.
   (C)   In the event the property owner does not comply with the foregoing notice and does not submit a written statement objecting to the recommended action, then the city may perform or have performed the recommended action.
   (D)   In the event the city performs the recommended action, then it may file a statement in the office of the Woodford County Clerk asserting a lien against the owner's property for the city's costs incurred in performing the actions recommended by the Tree Advisory Board.
