§ 91.061 COMMERCIAL ACTIVITIES ON SIDEWALKS.
   (A)   Commercial activity on sidewalks limited. Commercial activities and displays of merchandise for sale or exhibit, including but not limited to newspapers, soft drink machines, clothing, furniture, books and any and all merchandise or inventory for sale shall only be displayed upon public sidewalk and passways as allowed by this section.
   (B)   Commercial activity defined. Commercial activity and merchandise display shall be defined as the offering of any item for sale by use of the public sidewalks and passways of the city, such as but not limited to placing of vending machines, tables, display racks and other display devices upon the public sidewalks and passways of the city, and including rummage sales and garage sales.
   (C)   Commercial activity not to obstruct sidewalk. Any commercial activity and display of merchandise upon public sidewalks and passways shall be conducted in such a way as to allow the free passage of pedestrians, police and fire personnel upon the public sidewalk and passways without obstruction.
   (D)   Commercial activity limited to contiguous property. Commercial activity and merchandise display upon the public sidewalk and passways of the city shall only be allowed contiguous to the real property from which the commercial activity or merchandise originates.
   (E)   Hours of operation. Commercial activity and merchandise display upon the public sidewalks and passways of the city by persons owning or operating commercial and business activity upon contiguous real property shall be allowed only at the time that that person so owning or operating commercial activity on real property contiguous to public sidewalk or passways is open for business to the general public.
   (F)   Applicability. This section applies to any person who has custody or control of a commercial activity or merchandise display located upon a public sidewalk or passway within the city, or any person who has granted permission for commercial activity or merchandise display upon a public sidewalk or passway within the city.
   (G)   No expansion of use permitted by zoning ordinance. This section shall not be interpreted to in any way extend commercial activity or merchandise display into areas where the commercial activity or merchandise display would not be allowed by the Woodford County-Versailles-Midway Zoning Ordinance, or to otherwise allow commercial activity or merchandise display where not allowed by the Woodford County-Versailles-Midway Zoning Ordinance.
