§ 1430.03 REGISTRATION APPLICATION AND FEES.
   (a)   An applicant for a master underground utilities contractor's registration shall be at least 21 years of age and shall have at least two years of practical experience in performing underground utilities work as defined in this chapter. A master underground utilities contractor registration shall be issued to any person who has duly made application therefore and has passed the examination with a minimum score of 70% as prescribed by the City. Persons desiring to take the examination for a master underground utilities contractor registration shall make written application therefore accompanied by a fee of two hundred dollars ($200.00). Such fees shall not be refunded, but any applicant failing the examination shall be entitled to one re-examination without fee. Exams must be completed within 90 days of the application date. After passing the exam the contractor shall present evidence that they are insured in the minimum amount of one hundred thousand dollars ($100,000) for damage to persons and property arising out of any negligent act of the insured or any agent or employee of the insured and a bond approved by the Director of Law in the penal sum of ten thousand dollars ($10,000.00). Such bond shall be conditioned to reimburse the City for actual damages caused by act or omission of the underground utilities contractor to any property and to hold the City free and harmless from all claims for damages due to the negligence or misfeasance of such master underground utilities contractor, or that may be occasioned by reason of any opening made in any street, public land, alley or avenue, in the making of any connection with any public or private sewer. Such bond shall be in force from the date of its acceptance to the expiration date listed on the bond and must be renewed annually. The proof of insurance shall name the City of Middletown as the certificate holder. The master underground utilities contractor registration shall specify the name of the person so registered, who shall thereby be authorized to engage in the occupation of a master underground utilities contractor.
   (b)   An underground utilities installer registration shall be issued, without examination, to an underground utilities installer employed by a person registered as a master underground utilities contractor with the City upon application and payment of the fee of fifty dollars ($50.00). The underground utilities installer registration shall specify the name of the person so registered, who shall thereby be authorized to perform work as an underground utilities installer.
