§ 1066.07 RATES AND CHARGES.
   (a)   The following rates shall be charged to an occupant of residential premises in the City for the removal of garbage and rubbish therefrom at a frequency of once a week. All material shall be placed by the occupant at the curb lines where the street collections are made, or at the alley line where alley collections are made:
      (1)   Effective January 1, 2023: Eighteen dollars and fifty cents ($18.50) per month.
   (b)   The following rates shall be charged to an occupant of commercial premises in the City for the removal of garbage or rubbish therefrom at a frequency of once a week. The total garbage and rubbish to be removed shall not exceed two cans or containers of a maximum of 35 gallons each:
      (1)   Effective January 1, 2023: Eighteen dollars and fifty cents ($18.50) per month.
   (c)   Notwithstanding the provisions of division (a) hereof, the fee for collection of garbage and rubbish shall be reduced to 50% of normal residential rates for residential customers who are senior citizens and who meet the following criteria:
      (1)   The customer must be certified by the City, or an agency designated by it, as being 65 years of age or older;
      (2)   The customer must be legally responsible for payment of the fee; and
      (3)   The customer must apply for such rate, in writing, to the Public Works & Utilities Director, and show proof, as such Director requires, that the total income from all sources, including payments from governments, for the customer and all other persons residing in the customer’s home, qualifies as a “median-low income level” under the standards established by the United States Department of Housing and Urban Development for the Hamilton/Middletown area.
   (d)   Notwithstanding the provisions of division (a) hereof, the fee for collection of garbage and rubbish shall be reduced to 50% of normal residential rates for residential customers who are 100% disabled and who meet the following criteria:
      (1)   The customer must be certified by the City, or by an agency designated by it, as being a person who has been determined to be under a disability for purposes of receiving either supplemental security income or disability insurance benefits under the Federal Social Security Act, or has been certified totally 100% disabled by a public employee retirement plan or system or the United States Government.
      (2)   The customer must be the person legally responsible for payment of the fee.
      (3)   The customer must apply, in writing, for such rate with the Public Works & Utilities Director, and show proof, as such Director requires, that the total income from all sources, including payments from governments, for the customer and all other persons residing in the customer’s home, qualifies as a “median-low income level” under the standards established by the United States Department of Housing and Urban Development for the Hamilton/Middletown area.
   (e)   The reduced fee set forth in divisions (c) and (d) of this section shall apply only to the permanent residence of the customer.
   (f)   Unpaid bill to be collected with taxes. Each charge or rental levied by or pursuant to this chapter is made a lien upon the corresponding lot, land or premises provided trash service within the City, and if the same is not paid within 30 days after it is due and payable, it may be certified to the County Auditor who shall place the same on the tax duplicate of the County with the interest and penalties allowed by law and be collected as other taxes are collected.
