§ 1036.03 APPLICATION PROCEDURE.
   (a)   Applications for use of the public sidewalk or shared-use path or other real property within the public right-of-way, or renewal of previously granted uses similarly situated, shall be submitted in such form and in such manner as the rules and regulations developed pursuant to § 1036.02 shall require. Such application shall include, but not be limited to, the following information:
      (1)   Name, phone number and address of the applicant;
      (2)   Name and address of the business establishment seeking the occupancy;
      (3)   A description of the proposed area to be occupied by outdoor space and the hours and days of operation;
      (4)   A sketch or description of plans for area to be utilized, including measurements of area and location of any pedestrian diverters planned to demarcate the occupied area; location of the entrance to the establishment and location of exits; and
      (5)   A signed statement that the occupier/licensee shall hold harmless the City of Middletown, its officers and employees and shall indemnify the City of Middletown, its officers and employees for any claims or damage to property or injury to persons which may be occasioned by any activity carried on under the terms of the permit.
   (b)   All applications will be reviewed, and if approved, licenses or agreements shall be issued within 30 business days of submission.
