(a) The Engineering and Environmental Services Director is hereby authorized to cause written notice to be served upon the nearest station agent or section foreman of a railroad company or an abutting owner being served by spur railroad tracks, stating that the railroad crossing must be repaired to comply with § 1032.01. Such notice shall state the nature and extent of the required repairs, the manner of construction and a reasonable time in which such work shall be completed. No person shall fail to comply with such notice.
(b) In the event of noncompliance with an order issued pursuant to division (a) hereof and in addition to the penalty provided in § 1032.99, the Director is hereby authorized to cause such crossing to be repaired, as ordered, and recover the cost, with interest, in a civil action against the company in the name of the City.
