In any case where, by reason of excessive depth, width or size of a drainage ditch, the prohibition of § 1024.01 would impose a hardship or unreasonable restraint against any abutting property, the Engineering and Environmental Services Director may permit a partial filling or piping of such ditch if such act does not impede, obstruct or in any way change the flow of surface water within the ditch.
