(a) In order to obtain a permit, an application must be submitted by the owner or person in control of the premises where the adult entertainment establishment is to be located.
(b) An application for an original license must be submitted in writing, addressed to the Chief of Police of the City of Middletown. The application shall include:
(1) A nonrefundable filing fee in the amount of five hundred dollars ($500.00);
(2) The address of the premises where the adult entertainment establishment will be operated;
(3) The full name, address, social security number and date of birth of the applicant. If the applicant is a partnership, a limited partnership or a corporation, the name of the entity the status of the entity the state under which it is organized the address of its principal office and its principal office in Ohio, if different and its Federal employer identification number. If the applicant is a corporation, the name and address of its statutory agent in Ohio. If the applicant is a partnership, the full name, residence address, date of birth and social security number of each partner, the status of each partner, and whether the partnership has complied with Ohio R.C. 1777.02 (fictitious name statute);
(4) The full name, address, date of birth and social security number of the person to be responsible for the operation of the adult entertainment establishment for which a permit is sought;
(5) A statement that the applicant and, to the applicant's knowledge, the person named in response to division (b)(4) hereof, have never been convicted of or pleaded guilty to any offense other than a misdemeanor traffic offense, or a statement listing the offenses other than misdemeanor traffic offenses of which the applicant or the other person named in the application has been convicted, including the offense, the date of conviction and the name and location of the court;
(6) A statement by the applicant for a permit to operate an adult entertainment establishment that the Ohio Liquor Control Commission has never, pursuant to Ohio R.C. 4301.25 or any similar statute, law or municipal code from another state, revoked a permit held by the applicant or any person or entity named in the application and;
(7) A plat of the property described in division (b)(2) hereof, showing the property lines, building locations, parking areas, entry ways and lighting systems, buffering and fire protection services.
(c) All applicants shall execute an authorization for an investigation into the background of the applicant and any person or entity named in the application.
(d) All applicants shall execute a statement agreeing to abide by these regulations and laws of Ohio, and any amendments, additions, or reenactment thereof.
