§ 670.02 OPERATION ON MIAMI RIVER NEAR PUBLIC PARKS.
   On that part of the Miami River that borders any public park in the City:
   (a)   No person shall operate any watercraft, or manipulate any water skis, aquaplane or similar device carelessly or heedlessly, or in disregard of the rights or safety of any person, watercraft or property, or without due caution, at a rate of speed or in a manner so as to endanger any person, watercraft or property.
   (b)   No person who is under the influence of alcoholic beverages, narcotic drugs, opiates, or drugs of abuse shall operate, be in physical control of any watercraft underway, or manipulate any water skis, aquaplane, or similar device.

   (c)   No person shall operate a boat in such a manner as to unjustifiably or unnecessarily annoy or frighten the occupants of any other boat, or throw up a dangerous wake when approaching another boat.
   (d)   No person in charge of or occupying a boat shall dump or throw garbage, paper, bottles, cans, refuse or debris into the waterway.

   (e)   Whoever violates division (b) of this section is guilty of a misdemeanor of the first degree.
   (f)   Except as provided in division (e) hereof, whoever violates any of the provisions of this section is guilty of a minor misdemeanor on a first offense; for a second offense within one year after the first offense, such person is guilty of a misdemeanor of the fourth degree; for each subsequent offense within one year after the first offense, such person is guilty of a misdemeanor of the third degree.
