(a) No owner of lands abutting on any public street within the City shall maintain in or on the sidewalk abutting such property any covering or grating over any excavation in or under such sidewalk unless such covering or grating is so constructed as to be of the same grade and flush with the sidewalk surrounding it. Such covering or grating shall be substantially constructed of metal and the exposed portion thereof shall not be smooth and shall be such as to permit its safe use by persons passing thereon.

(b) No owner of property within the City maintaining any cover or grating in or on any sidewalk or over any excavation in or under such sidewalk, which covering or grating is considered unsafe or unsound by the Superintendent of Inspection, shall, within three days after having been notified by the Clerk of the City Council to do so, fail to cause such covering or grating to be made safe and secure.

(c) Whoever violates division (b) hereof is guilty of a minor misdemeanor. A separate offense shall be deemed committed each day during or on which a violation occurs or continues.
