For purposes of this chapter, the following definitions shall apply.
(a) CURFEW HOURS.
(1) For any minor under 16 years of age:
A. 11:00 p.m. on any Sunday, Monday, Tuesday, Wednesday or Thursday until 6:00 a.m. of the following day; and
B. 12:01 a.m. until 6:00 a.m. on any Saturday or Sunday.
(2) For any minor 16 years of age or older:
A. 12:01 a.m. until 6:00 a.m. any Monday, Tuesday, Wednesday, Thursday or Friday; and
B. 1:00 a.m. until 6:00 a.m. on any Saturday or Sunday.
(b) EMANCIPATED. A minor who is married or has been adjudged by a court of competent jurisdiction to be emancipated.
(c) EMERGENCY. An unforeseen combination of circumstances, or the resulting state that calls for immediate action. The term includes, but is not limited to, a fire, a natural disaster or an automobile accident, and is intended to include any situation requiring immediate action to prevent serious bodily injury or loss of life.
(d) ESTABLISHMENT. Any privately-owned place of business operated for a profit to which the public is invited, including, but no limited to, any place of amusement or entertainment.
(e) GUARDIAN.
(1) A person who, by court order, is the guardian of the person of a minor; or
(2) A public or private agency with whom a minor has been placed by a court.
(f) MINOR. A person who is under eighteen years of age.
(g) OPERATOR. Any individual, firm, association, partnership, corporation or other business entity operating, managing or conducting any establishment. The term includes the members or partners of an association or partnership and the owners of corporation.
(h) PARENT. A person who is a natural parent, adoptive parent or step-parent of another person.
(i) PUBLIC PLACE. Any place to which the public or a substantial portion of the public has access, and includes, but is not limited to, streets, highways, sidewalks, parks, driveways, playgrounds and common areas of schools, hospitals, apartment houses, office buildings, transportation facilities and commercial areas.
(j) REMAIN. To linger, to stay, to tarry or to fail to leave a premises or place when requested to do so by a police officer or the owner, operator or other person in control of the premises.
(k) SERIOUS BODILY INJURY. Bodily injury that creates a substantial risk of death or that causes death, serious permanent disfigurement or protracted loss or impairment of the function of any bodily member or organ.
