The City shall not, except in an emergency situation as determined by the City Manager, rehire or reinstate a retired employee of the City to his or her former position, in a full-time status, when such retired employee is receiving a pension equal to or exceeding 50% of the retired employee’s “final average salary” as that term is defined in Ohio R.C. 145.01(K), or “average annual salary,” as that term is defined in Ohio R.C. 742.01(G). Nothing in this section is intended to prohibit the City from hiring a retired employee to a part-time position or a full-time position other than his or her former position.
