§ 250.241 PROMOTIONS; POLICE AND FIRE DIVISIONS.
   (a)   Chief and Assistant Chief of the Division of Fire. The position of the Chief of the Division of Fire and the Assistant Chief of the Division of Fire shall be filled by using the following procedure:
      (1)   Eligibility.
         A.   Persons holding the rank of Deputy Chief or Assistant Chief in the Division of Fire, and having held either rank (or a combination of the ranks) for a period of one year prior to the announcement of the test, are eligible to compete for the position of Chief of the Division of Fire.
         B.   Persons holding the rank of Deputy Chief in the Division of Fire for at least one year prior to the announcement of the test are eligible to compete for the position of Assistant Chief in the Division of Fire.
         C.   If less than two eligible persons register to compete for the position of Chief of the Division of Fire during the scheduled period of registration, the registration shall be reopened and those employees holding or having held the next lower rank for at least one year period will be eligible. If less than two eligible persons register to compete for the position of Assistant Chief in the Division of Fire during the scheduled period of registration, the registration shall be reopened and those employees holding or having held the next lower rank for at least one year period will be eligible.
      (2)   Testing.
         A.   Each candidate will be required to participate in an assessment process. The assessment process will be developed and administered at the sole discretion of the City of Middletown, subject to review and approval by the City Manager and the Middletown Civil Service Commission. Upon completion of the assessment process, the assessors shall issue a written report on each candidate, which should include an analysis of the candidate’s ability to perform the position and his or her strengths and weaknesses and such other information that the assessor deems relevant. The report shall rank the candidates numerically in order of their performance in the assessment process.
      (3)   Certification and selection.
         A.   All candidates completing the assessment center shall be certified to the appointing authority for consideration for appointment to the position by the Civil Service Commission.
         B.   The appointing authority may conduct additional testing, including, but not limited to, psychological examination, and interviews as he or she deems necessary.
         C.   The appointing authority may select any candidate from the eligibility list.
         D.   The list of candidates as certified from the last assessment center shall be in full force and effect for a period of one year from the date it is certified.
   (b)   Chief of the Division of Police. The position of the Chief of the Division of Police shall be filled by using the following procedure.
      (1)   Eligibility.
         A.   Persons holding the rank of Deputy Chief or Lieutenant in the Division of Police, and having held such rank for a period of one year prior to the test date, are eligible to compete for the position of Chief of the Division of Police.
         B.   If less than two eligible persons register to compete for the position of Chief of the Division of Police, during the scheduled period for registration, the registration shall be reopened and those employees holding or having held the rank of Deputy Chief or Lieutenant for less than one year prior to the test date will be eligible to compete for the position of Chief of the Division of Police.
         C.   If less than two eligible persons register to compete during the re-opened scheduled registration period, those employees holding the rank of Sergeant for a minimum of two years prior to the test date will be eligible to compete for the position of Chief of the Division of Police.
      (2)   Testing.
         A.   Each candidate will be required to participate in an assessment process. Each candidate must pass the assessment process with a score of 70% or above. The assessment process will be developed and administered at the sole discretion of the City of Middletown by the Human Resources Division, subject to the review and approval of the City Manager and the Middletown Civil Service Commission. The City Manager shall determine the personnel to administer the assessment process. The assessors may include City of Middletown employees or officials, but shall include at least one assessor who is not an employee or official of the City.
         B.   The assessment process shall consist of exercises designed to test the candidates' ability to perform the position of Chief of Police, as determined at the discretion of the City of Middletown.
         C.   The assessment team shall report to the City of Middletown Human Resources Division concerning each candidate's performance in a format determined by the City.
      (3)   Certification and selection.
         A.   All candidates passing the assessment center with a 70% or above shall be certified to the appointing authority for consideration for appointment to the position by the Middletown Civil Service Commission.
         B.   The appointing authority may conduct additional testing, including, but not limited to, psychological examination and interviews as he or she deems necessary.
         C.   The appointing authority may select any candidate from the eligibility list.
         D.   The list of candidates as certified from the last assessment center shall be in full force and effect for a period of one year from the date it is certified.
   (c)   Deputy Chief in the Division of Police. The position of Deputy Chief in the Division of Police shall be filled by using the following procedure.
      (1)   Eligibility.
         A.   Persons holding the rank of Lieutenant in the Division of Police, and having held such rank for a period of one year prior to the test date, are eligible to compete for the position of Deputy Chief in the Division of Police.
         B.   If less than two eligible persons register to compete for the position of Deputy Chief in the Division of Police, during the scheduled period for registration, the registration shall be reopened and those employees holding or having held the rank of Lieutenant for less than one year prior to the test date will be eligible to compete for the position of Deputy Chief in the Division of Police.
         C.   If less than two eligible persons register to compete during the re-opened scheduled registration period, those employees holding the rank of Sergeant for a minimum of two years prior to the test date will be eligible to compete for the position of Deputy Chief in the Division of Police.
      (2)   Testing.
         A.   Each candidate will be required to participate in an assessment process. Each candidate must pass the assessment process with a score of 70% or above. The assessment process will be developed at the sole discretion of the City of Middletown, by the Human Resources Division subject to the review and approval of the Chief of Police, City Manager and the Middletown Civil Service Commission. The assessment process will be administered by an outside testing firm.
         B.   The assessment process shall consist of exercises designed to test the candidates' ability to perform the position of Deputy Chief of Police, as determined at the discretion of the City of Middletown.
         C.   The assessment team shall report to the City of Middletown Human Resources Division concerning each candidate's performance in a format determined by the City.
      (3)   Certification and selection.
         A.   All candidates passing the assessment center shall be certified to the appointing authority for consideration for appointment to the position by the Middletown Civil Service Commission.
         B.   The City may conduct additional testing, including, but not limited to, psychological examination and interviews as it deems necessary.
         C.   The appointing authority may select any candidate on the list upon the recommendation of the Chief of Police.
         D.   The list of candidates as certified from the last assessment center shall be in full force and effect for a period of one year from the date it is certified.
   (d)   Lieutenants in the Division of Police. The position of Lieutenant in the Division of Police shall be filled by using the following procedure.    
      (1)   Eligibility.
         A.   Persons holding the rank of Sergeant in the Division of Police and having held such rank for a period of one year prior to the test date are eligible to compete for the position of Lieutenant in the Division of Police.
         B.   If less than three eligible persons register to compete for the position of Lieutenant in the Division of Police, during the scheduled period for registration, the registration shall be reopened and those employees holding or having held the rank of Sergeant for less than one year at the test date will be eligible to compete for the position of Lieutenant in the Division of Police.
         C.   If less than three eligible persons register to compete during the re-opened scheduled registration period, those employees holding the rank of Patrol Officer for a minimum of five years prior to the test date will be eligible to compete for the position of Lieutenant in the Division of Police.
      (2)   Testing.
         A.   There shall be a written examination for the position of Lieutenant in the Division of Police. Each candidate must pass the written test with a score of 70% or above to be eligible for participation in the assessment process. No seniority will be added to the written exam score.
         B.   Each candidate passing the written examination will be required to participate in an assessment process. Each candidate must pass the assessment process with a score of 70% or above, prior to the addition of any seniority points. The assessment process will be developed at the sole discretion of the City of Middletown, by the Human Resources Division, subject to review and approval by the Chief of Police, City Manager and the Middletown Civil Service Commission. The assessment process will be administered by an outside testing firm.
         C.   Each candidate participating in the assessment process shall be assigned a numerical score by the assessors based on their performance in the assessment center. Seniority points will be added to the assessment process score with the highest score being ranked as 1.
         D.   The assessment process shall consist of exercises designed to test the candidates' ability to perform the position of Lieutenant, as determined at the discretion of the City of Middletown.
         E.   The assessment team shall report to the City of Middletown Human Resources Division concerning each candidate's performance in a format determined by the City.
      (3)   Certification and selection.
         A.   All candidates passing participating in the assessment process shall be placed on an eligible list, certified by the Middletown Civil Service Commission, for the position of Lieutenant in the Division of Police in the order of ranking. Upon the occurrence of a vacancy, the top three candidates, by rank, on the list shall be certified to the appointing authority for consideration for appointment to the position.
         B.   The City may conduct such additional testing, including, but not limited to, psychological examinations and interviews as it deems necessary.
         C.   The appointing authority shall select a person to fill the vacancy from the three persons certified to him or her from the eligible list.
         D.   If less than three of the candidates successfully pass the written examination and the assessment center, the appointing authority may either:
            1.   Fill the position with one of the candidates who has successfully passed both the written examination and the assessment center; or
            2.   Order a retest including both the written examination and the assessment center, in which the employees holding or having held the next lower rank below those eligible for the first testing process shall be eligible. If a retest is ordered, the rules for testing, certification and selection will be the same as previously set forth as based on the retest. Any person having successfully passed the written examination and the assessment center for the position prior to the retest, shall be merged on the new list in order of ranking.
         E.   The eligible list shall be in full force and effect for a period of one year from the date it is certified.
   (e)   Sergeant in the Division of Police. The position of Sergeant in the Division of Police shall be filled by using the following procedure.
      (1)   Eligibility.
         A.   Persons holding the rank of Police Officer in the Division of Police, and having held such rank for a period of five years prior to the announcement of the test, are eligible to compete for the position of Sergeant in the Division of Police.
         B.   If less than three eligible persons register to compete for the position of Sergeant in the Division of Police, during the scheduled period for registration, the registration shall be reopened, and those employees holding or having held the rank of Police Officer for a minimum of three years will be eligible.
      (2)   Testing.
         A.   There shall be a written examination for the position of Sergeant in the Division of Police. Each candidate must pass the written test with a score of 70% or above to be eligible for participation in the assessment process. No seniority points will be added to the written exam score.
         B.   Each candidate passing the written examination will be required to participate in an assessment process. Each candidate must pass the assessment process with a score of 70% or above, prior to the addition of any seniority points. The assessment process will be developed at the sole discretion of the City of Middletown, by the Human Resources Division, subject to review and approval by the Chief of Police, City Manager and the Middletown Civil Service Commission. The assessment process will be administered by an outside testing firm.

         A.   All candidates passing in the assessment process shall be placed on an eligible list, certified by the Middletown Civil Service Commission, for the position of Sergeant in the Division of Police, in the order of ranking. Upon the occurrence of a vacancy, the top three candidates, by rank, on the list shall be certified to the appointing authority for consideration for appointment to the position.
         B.   The City may conduct such additional testing, including, but not limited to, psychological examinations and interviews as it deems necessary.
         C.   The appointing authority shall select a person to fill the vacancy from the three persons certified to him or her from the eligible list.
         D.   If less than three of the candidates successfully pass the written examination and the assessment center, the appointing authority may either:
            1.   Fill the position with one of the candidates who has successfully passed both the written examination and the assessment center; or
            2.   Order a retest including both the written examination and the assessment center, in which the employees holding or having held the next lower rank below those eligible for the first testing process shall be eligible. If a retest is ordered, the rules for testing, certification and selection will be the same as previously set forth as based on the retest. Any person having successfully passed the written examination and the assessment center for the position prior to the retest, shall be merged on the new list in order of ranking.
         E.   The eligible list shall be in full force and effect for a period of one year from the date it is certified.
