§ 205.08 EMERGENCY PROCUREMENT.
   Notwithstanding any provision of these Codified Ordinances to the contrary, the City Manager upon declaration of a state of emergency by proclamation as provided in § 205.02, may procure by purchase or lease, such goods and services, including but not limited to, equipment and manpower, as are deemed necessary for the City’s emergency response effort. This emergency procurement of goods or services may be made in the open market without compliance with any procedure for advertising or obtaining bids, as required in Ohio R.C. Chapter 735, or waiving such bids, as required in Chapter 209 of these Codified Ordinances. If, during a state of public emergency, there are insufficient funds appropriated to purchase goods and services, including, but not limited to, equipment and manpower, which the City Manager deems necessary to the City’s emergency response and/or the repair of City facilities, the City Manager is authorized to expend an amount not to exceed fifty thousand dollars ($50,000.00) without further action by the City Council in response to emergency or disaster situations. A full written account of all emergency procurements made during this emergency, together with a requisition for the required materials, supplies, equipment, or services, shall be submitted to or provided by the City Manager within 30 days after their procurement, and shall be open to public inspection for a period of at least one year subsequent to the date of the emergency purchases. The City Manager shall, within 30 days of the conclusion of the emergency, formally communicate these emergency expenditures in a full written account to the City Council.
