All proper costs and expenses incurred under the authority of this act [this article] by said board or inspector of buildings shall be certified by them to the town treasurer of said town who shall assess the same against the owner of said real estate, and the said town treasurer may recover the said costs and expenses for the use of the Town of Middletown in a suit at law against said owner. After judgment in said suit, said real estate may be sold under the aforesaid lien in the same manner as in the case of attachment of real estate, and all costs and expenses incurred by said board, and the said inspector of buildings, including all costs and reasonable fees, for the prosecution of said suit shall be deducted from the proceeds of said sale, and the balance thereof, if any, paid over to the rightful owner thereof.
