1310.02  AMENDMENTS.
   The following sections are hereby revised:
   Section 101.1.  Insert:  Village of Middleport
   Section 103.5.  Insert:  See Codified Ordinance Section 1307.04
   Section 112.4.  Insert:   Any person who shall continue any work after having been served with a stop work order, except such work as that person is directed to perform to remove a violation or unsafe condition, shall be liable to
   Section 301.4  Insert:   Payment of Utility Bills Prior to Rental.  Dwellings or dwelling units may not be rented or used until water and sewage bills are paid in full.
   Section 301.5  Insert:    (a)    Rental properties are defined as properties that are currently income-producing or are ready for  rental occupancy.  It is the property owner's responsibility to inform the village of any new rental property and pay required fees.
               (b)   All rental unit owners are to have a permit to rent dwellings each calendar year.  Cost of the rental  permit is twenty dollars ($20.00) per year, per rental unit.
               (c)   The deadline for payment of rental permit fees shall be the 28th of February of each year.
                               (d)   All rental properties are required to have working smoke detectors. It is the property owner's responsibility to supply and maintain smoke detectors.
               (e)   All rental units will be scheduled to be inspected by the Building Inspector once each year. All rental units must comply with all applicable codes. The Building Inspector will notify the property owner of the date and time of inspection.  It is the property owner's responsibility to contact his renter about the impending inspection.

                             (f)   If the Building Inspector finds that repairs are needed at a rental unit, the landlord will be allowed 30 days to perform repairs and contact the Building Inspector for re-inspection.  A fee of fifteen dollars (15.00) will be charged for this re-inspection.  After 30 days, if the Building Inspector finds that repairs have not been completed, the premises must be vacated and there will be a fine of one hundred dollars ($100.00) imposed upon the property owner.  There will be a fine of one hundred dollars ($100.00) imposed upon the property owner every 30 days thereafter until  the Building Inspector finds repairs have been performed and the rental unit passes inspection.  Extensions of time for major repairs may be permitted at the Building Inspector's discretion.  (Ord. 82-13.  Passed 3-11-13.)
               (g)   Whoever refuses to comply with the rental unit inspection process, or, when notified, does not respond or reply within a 10 day period with just cause as to why they can not comply, shall be considered in violation of the rental unit regulations.
               (h)   Water service will not be turned on at a rental unit until that unit and the real property on which the rental unit is located has passed inspection and the Building Inspector has confirmed that a rental permit has been issued.
               (i)   Prior to a new tenant moving into a rental unit, that unit and the real property on which it is located, must pass inspection.  A twenty five dollar ($25.00) fee for this inspection will be charged to the landlord.  A landlord or tenant may request an inspection of any rental unit at any time.  A twenty- five dollar ($25.00) fee for this inspection will be charged to the one who requests the inspection.

   Section 301.6  Insert:   Water service will not be turned on at any property until any and all fees or monies associated  with that property and owed to the Village of Middleport have been paid in full.
   Section 302.4  Insert:       Twelve inches
   Section 303.2  Amended:   (Swimming Pools, Spas and Hot Tubs) Enclosures. In ground hot tubs and spas, containing water more than 24 inches (610mm) in depth shall be completely surrounded by a fence or barrier at least 48 inches (1219mm) in height.  Gates and doors in such barriers shall be self-closing and self-latching.
       Exception: Spas or hot tubs with a safety cover that complies with ASRM F 1346 shall be exempt from the provisions of this section.
