Strip mining for coal must comply with the following conditions and requirements:
(a) All operations must be conducted no closer than 100 feet to any adjacent property, except that the Board of Zoning Appeals may allow operations within the 100 foot area upon written permission of the adjacent property owner.
(b) The operator shall file with the Board a location map which clearly shows areas to be mined and the location of adjacent properties, roads and natural features.
(c) The operator shall submit information on the anticipated depth of excavations and on the depth and probable effect upon the existing water table.
(d) The operator shall file with the Board a detailed plan for the restoration of the area to be mined which shall include the anticipated future use of the restored land, the proposed final topography indicated by contour lines of no greater interval than five feet, steps which shall be taken to conserve topsoil; the type and number per acre of trees or shrubs to be planted; and the location of future roads, drives, drainage courses or other improvements contemplated.
(e) The operator shall file with Council a bond, payable to the Village and conditioned on the faithful performance of all requirements contained in the approved restoration plan. The rate, per acre of property to be mined, of the required bond shall be as fixed by ordinance or resolution of Council. The bond shall be released upon written certification of the Zoning Inspector that the restoration is complete and in compliance with the restoration plan.
