135.041 ASSISTANT VILLAGE ADMINISTRATOR.
   The Assistant Village Administrator shall assist the duly-appointed Village Administrator and shall fulfill such duties as may be assigned to him/her by the Village Administrator, the Mayor and/or Council.
   (a)   Appointment. The Assistant Village Administrator shall be appointed by the Mayor, upon the advice of the Village Administrator. Said appointment shall take effect when confirmed by the majority of the members elected to Council.
   (b)   Bond. Before assuming the position, in order to allow the Assistant Village Administrator to perform fiscal functions delegated by the Village Administrator, the Assistant Village Administrator shall qualify for and obtain a Fidelity Bond in the amount of $100,000.00, conditioned upon the faithful performance of his/her duties, with a surety satisfactory to Council and licensed to do business in the State of Ohio. Such bond shall be filed with the Fiscal Officer, after being approved by Council. The cost of such bond shall be borne by the Village.
   (c)   Responsibilities and Duties. The Assistant Village Administrator shall perform all functions delegated to him/her by the Village Administrator, as well as such other specific duties and responsibilities assigned by the Mayor and/or Council.
      (1)   The Village Administrator may assign to the Assistant Village Administrator any of the Village Administrator's responsibilities and duties, as described in Section 135.04, provided that such delegation is first approved by the Mayor.
      (2)   In the event that the Village Administrator is absent from the Village for more than seventy-two (72) hours, or is otherwise incapacitated, the Assistant Village Administrator may act as and for the Village Administrator during such period of such absence or incapacity.
      (3)   Council, in its discretion, may elect to have the Assistant Village Administrator also fulfill the duties of the Zoning Inspector and/or the Economic Development Director.
   (d)   Residency. The Assistant Village Administrator need not reside in the Village at the time of appointment, however, the Assistant Village Administrator shall become a resident of the Village within six (6) months after appointment and confirmation by Council unless Council, by ordinance, determines otherwise.
   (e)   Tenure. The Assistant Village Administrator shall serve at the pleasure of the Mayor and the Council and may be removed without cause by the Mayor without the consent of a majority of the members elected to Council; or the Assistant Village Administrator may be removed without the consent of the Mayor by the affirmative vote of three-fourths (3/4) of the members elected to Council. Prior to taking any such vote, the Mayor and Council shall seek the advice of the Village Administrator, but shall not be obligated to follow same.
   (f)   Job Description. The Village Administrator shall prepare a written job description for the Assistant Village Administrator, which shall be approved by a majority of the members of Council.
