139.01 OFFICERS.
   (a)   The Police Department of the Municipality shall consist of a Marshal, who shall be designated as Chief of Police, one Deputy Marshal, who shall be designated as Lieutenant, one Deputy Marshal who shall be designated as Sergeant, and such other Deputy Marshals as are hereinafter provided for, who shall be designated as Police Officers. The Chief of Police shall be appointed by the Mayor, subject to confirmation of Council. At a minimum, the Council shall fill the position of Chief of Police and at least the positions of Lieutenant and Sergeant.
   (b)   Subject to such general rules as the Mayor may prescribe, the Chief of Police shall be the head of the Police Department and responsible for the daily operation and supervision of the Department. It shall be the duty of the Chief of Police to make written reports on the activities of the Police Department to the Mayor and to the Public Safety Committee of Council and make any recommendations which the Chief may have for the more efficient operation of the Department. The Mayor, with approval by Council, shall designate the hours of work of the Chief in order to provide for adequate and efficient operation of the Police Department.
   (c)   The Lieutenant shall be appointed by the Mayor after considering recommendation(s) from the Chief of Police and this appointment shall be subject to confirmation by Council. Such appointment shall be subject to the following conditions:
      (1)   The Lieutenant shall be appointed only from those persons who have worked in the Village in the position of “Sergeant”, and who have been in that position for a minimum of three years.
      (2)   The appointee must be of sound mental and physical health.
      (3)   At the time of appointment, the appointee shall have no active disciplinary finding more severe than a written reprimand.
      (4)   Any appointment or promotion to the position of Lieutenant shall be for a probationary period of six months, and such appointment or promotion shall not become final until such Lieutenant has satisfactorily served his/her probationary period and the final appointment is made in accordance with Ohio R.C. 737.17. If at the conclusion of such probationary period such Lieutenant is not finally appointed as such, he/she shall revert back and be demoted to his/her previous status and pay schedule.
      (5)   The appointment of the Lieutenant shall be subject to the “Departmental Policies and Standards”, promulgated pursuant to Section 139.03.
      (6)   For good cause, the Mayor, with approval of a majority of the Council, may waive any of the foregoing requirements.

   (d)   In addition to his/her usual duties as a full-time member of the Police Department, the Lieutenant shall assist the Chief of Police in the Chief's supervision and management of the Police Department. During the absence from the Village or the incapacity of the Chief of Police, the Lieutenant shall become Acting Chief of Police, and during such time the Lieutenant shall be vested with all of the authority of the Chief of Police. The Lieutenant shall act as Jail Administrator and shall perform such other duties as set forth in the job description for the rank of Lieutenant, or as shall be ordered or directed by the Chief of Police.
   (e)   The Sergeant shall be appointed by the Mayor after considering recommendation(s) from the Chief of Police and this appointment shall be subject to confirmation by Council. Such appointment shall be subject to the following conditions:
      (1)   The Sergeant shall be appointed only from those persons who have worked in the Village in the position of “Police Officer” and who have been in that position for a minimum of three years continuous service.
      (2)   The appointee must be of sound mental and physical health.
      (3)   At the time of appointment, the appointee shall have no active disciplinary finding more severe than a written reprimand.
      (4)   Any appointment or promotion to the position of Sergeant shall be for a probationary period of six months, and such appointment or promotion shall not become final until such Sergeant has satisfactorily served his/her probationary period and the final appointment is made in accordance with Ohio R.C. 737.17. If at the conclusion of such probationary period such Sergeant is not finally appointed as such, he/she shall revert back and be demoted to his/her previous status and pay schedule.
      (5)   The appointment of the Sergeant shall be subject to the Departmental Policies and Standards promulgated pursuant to Section 139.03.
      (6)   For good cause, the Mayor, with approval of a majority of the Council, may waive any of the foregoing requirements.
   (f)   In addition to his/her usual duties as a full-time members of the Police Department, the Sergeant shall assist the Chief of Police and the Lieutenant in their supervision and management of the Police Department.
   The Sergeant shall perform such other duties as set forth in the job description for the rank of Sergeant, the duties described in the Departmental Policies and Standards promulgated pursuant to Section 139.03 and as shall be ordered or directed by the Chief of Police or the Lieutenant.
   (g)   Police Officer. A Police Officer shall be a full-time police officer and shall be appointed by the Mayor upon the recommendation of the Chief of Police, subject to confirmation by Council. The appointment of the Police Officer shall be subject to the Departmental Policies and Standards promulgated pursuant to Section 139.03.
   To be eligible for appointment, a candidate must have successfully completed all schooling required by the State of Ohio Peace Officers Training Council and be state certified. Persons appointed as Police Officer shall serve a probationary period of a minimum of six months and a maximum of one year. At the conclusion of the probationary period, the Mayor shall transmit to the Council a record of the employee’s service with his recommendations thereon and he may, with the concurrence of the Council, remove or finally appoint the employee as Police Officer.
   (h)   Part-Time Police Officer. Part-time Police Officers shall be appointed by the Mayor, subject to the confirmation of Council, upon the recommendation of the Chief of Police. Prior to appointment, Part-Time Police Officers shall have completed all schooling required by the State of Ohio Peace Officers Training Council and be state certified.
   (i)   No person shall receive an appointment under this section unless, not more than 60 days prior to receiving such appointment, that person has passed a physical examination, given by a licensed physician, demonstrating that the applicant meets the physical requirements necessary to perform the duties of the appointment, and successfully completed a polygraph examination and related background check.
