1460.02 INSPECTIONS; PHOTOGRAPHS; NOTICE TO CORRECT.
   (a)   Whenever the Chief Building Official suspects the existence of a public nuisance in the City, he or she shall promptly cause to be inspected the premises on which he or she suspects such public nuisance to exist. Should the Chief Building Official or designee find that a public nuisance does exist, he or she shall promptly notify the Fire Chief, whereupon the Fire Chief shall cause to be inspected the premises on which it is suspected that such public nuisance exists. Written reports of the inspection and of their findings with respect to the existence of the public nuisance shall be filed with the Chief Building Official.
      (1)   Should the Fire Chief concur that a public nuisance exists, it shall be the duty of the Chief Building Official to cause photographs of such nuisance to be made and to file and keep in his or her office the written reports of the findings of the Fire Chief. The Chief Building Official shall cause a written notice to be served on the owner of the property stating the findings with respect to the existence of a public nuisance and stating that unless the owner thereof shall cause the abatement of the public nuisance by removal of the building or structure, the same will be abated by the City at the expense of the owner. Such abatement shall start within 15 days after service of the notice and shall be completed within 45 days or such additional time as the Chief Building Official may deem necessary to complete the removal.
   (b)   In cases where the Chief Building Official finds the nuisance condition exists which constitutes an emergency involving immediate danger to human life or health, or an immediate threat of substantial and/or irreparable physical or economic damage to a structure, the Chief Building Official may declare such condition a nuisance and order its immediate abatement, and the Chief Building Official may take action necessary to immediately abate the violation constituting a nuisance without advance notice to the owner. Such action may include entering property for the purposes of conducting an inspection, to the extent and in the manner allowed by law, ordering that the property be immediately vacated, ordering the cessation of utility service if necessary to protect life, health or property, and/or abate the violation constituting the nuisance.
      (1)   If the Chief Building Official abates a nuisance pursuant to this section, notice shall be provided to the owner within three days after the start of the abatement work, stating the findings with respect to the existence of a public nuisance and stating the action taken.
      (2)   Such notice shall be delivered to the property owner in the same manner as notice is required in Section 1460.02(a)(1) and posted on the subject property.
