The chief executive of the City, as City Manager, is hereby authorized and directed to confer with the Chairperson of the District Advisory Council of the Montgomery County Combined General Health District in regard to the union of the health districts and to enter into a contract to combine the health districts as provided for in Ohio R.C. 3709.07. Such contract shall provide the following:
(a) The Board of Health of the combined general health district shall be the Board of Health of the original general health district.
(b) Members of the Board of Health of the Montgomery County Combined General Health District shall be appointed in accordance with Ohio R.C. 3709.03.
(c) The City Manager of the City of Miamisburg shall be a member of the District Advisory Council.
(d) The contract shall become effective upon execution and shall remain in full force and effect until terminated by either party. Such contract shall contain appropriate termination clauses.
(e) The proportion of expenses or the method of apportioning the expenses of the health districts that are forming the combined health district shall be indicated.
(f) The contract shall not serve to vitiate any prior contracts between the City of Miamisburg and the Montgomery County Combined General Health District, provided, however, that where such contract contains provisions in conflict with any prior contracts the latest contract shall be controlling.
