The following parties may be granted a beach vending permit or conduct activities pursuant to a beach vending permit:
(A) The owner of the qualifying upland parcel;
(B) The lessee operator of the hotel, motel, restaurant, tavern, or bar located on the qualifying upland parcel;
(C) A third party who has written permission from either of the two above parties to conduct business on the beach that is on or behind the qualifying parcel.
