A. Approved Materials and Equipment: All materials, equipment and devices approved for use by the Building Administrator shall be constructed and installed in accordance with such approval.
B. Modifications: When there are practical difficulties involved in carrying out structural or mechanical provisions of this Building Code, the Building Code Board of Appeals may modify such provision upon application of the owner or his representative, provided that the spirit and intent of the law shall be observed and public welfare and safety be assured.
C. Records: The application for modification shall be in writing on forms provided by the Building Administrator and the decision of the Building Code Board of Appeals shall be maintained with the application for the permit in the permanent records of the Building Administrator.
D. Previously Used Materials and Equipment: Previously used materials, equipment and devices may be used, provided they have been reconditioned, tested and placed in good and proper working condition and approved for use by the Building Administrator.
E. Alternate Materials and Equipment: The provisions of this Building Code are not intended to prevent the use of any material or method of construction not specifically prescribed by this Building Code, provided any such alternate has been approved by the Building Code Board of Appeals, which may approve any such alternate provided it finds that the proposed design is satisfactory and complies with the intent of the provisions of this Building Code, and that the material, method or work offered is, for the purpose intended, at least the equivalent of that prescribed in this Building Code in quality, strength, effectiveness, fire resistance, durability and safety.
F. Preliminary Inspection: Before issuing a permit, the Building Administrator may examine or cause to be examined all buildings, structures and sites for which an application has been filed for a permit to construct, enlarge, alter, repair, remove, demolish or change the use thereof; and he may conduct such inspections from time to time during and upon completion of the work for which he has issued a permit; and he shall maintain a record of all such examinations and inspections and of all violations of this Building Code.
G. Required Inspections: In accord with Section 9.109, after issuing a Building Permit the Building Administrator shall conduct such inspections from time to time during the progress of the work to determine its conformity with this Building Code and the approved plans. Upon completion of the work for which he has issued a permit; and he shall maintain a record of all such examinations and inspections and of all violations of this Building Code.
H. Accredited Inspection Services: He may accept reports of his own inspectors or may require and accept inspection and reports of accredited consulting organizations.
I. Inspection Reports: All inspection reports shall be in writing and shall be certified by the licensed authority or responsible officer of the service or the individual when expert inspection services are accepted. An identifying label or stamp permanently fixed to the product indicating that factory inspection has been made may be accepted in lieu of the aforesaid inspection report in writing if the intent or meaning of such identifying label or stamp is properly substantiated.
J. Final Inspection: Upon completion of the building or structure, and before issuance of the Occupancy Certificate required in Article V, a final inspection shall be made and all violations of the approved plans, permit and Building Code shall be noted and the holder of the permit shall be notified of the discrepancies. "Occupancy" and/or "Use" shall not be allowed until these violations are corrected and reinspection approved. Work done under each Building Permit must receive a final inspection and, thereafter an Occupancy Certificate must be issued, if the work is approved and has been constructed in accord with this Chapter and the plans submitted therefor. If the Building Administrator fails to approve the work through its final inspection, the violations of this Building Code or other ordinances shall be corrected by the contractor and notice given the Building Administrator that the building is ready for re-inspection. When the Building Administrator finds that the building is Substantially Completed after one or more re-inspections, he shall issue an Occupancy Certificate.
K. Right of Entry: In the discharge of his duties, the Building Administrator or his authorized representative shall have the authority to enter at any reasonable hour any building, structure or premises in the corporate limits of the Village to enforce the provisions of this Building Code.
L. Architect's Certification of Work: Prior to the issuance of an Occupancy Certificate, the architect or engineer who prepares the plans as required by Section 9.111 shall submit a letter to the Building Administrator certifying that the structure has been built or remodeled substantially in conformance with the plans he prepared. This provision shall not apply to single-family residences unless the Building Administrator determines that the work is of such an unusual nature that the letter of certification should be required. In this event the permit applicant and the architect shall be so notified.
M. Time of Inspections: The Permittee shall notify the Building Administrator or inspection consultant at each of the times when his work has progressed to the point where it is ready for the next inspection. The method and procedure for notification to be determined by the Building Administrator. At least forty-eight (48) hours' advance notice of the desired inspection shall be made by the Permittee.
N. Obstruction of Inspection: No work shall be done which will cover or obstruct from view construction work scheduled for inspection which is not yet approved by the Building Administrator.
O. Approval: As each stage or item of construction is approved, the approval shall be recorded by the Building Administrator on the Building Permit placard and on his office records, thereby authorizing the continuation of the work.
P. Disapproval: In case the work that has been done or is about to be done does not conform with this Building Code or other applicable ordinances, the Building Administrator shall, at once, notify the contractor verbally, confirm the notification in writing, citing the violations of this Building Code or other ordinances which are the reason for his disapproval and specifying the material that is to be removed, replaced or repaired. That portion of the work which is disapproved shall be corrected by the contractor and reinspected by the Building Administrator.
Q. Stop Work Order: The Building Administrator or his designee shall issue an order, being a Stop Work Order, to stop certain work or to stop all work on a Building or structure or part thereof or upon any parcel of real property when work is being prosecuted contrary to provisions of this Building Code or in an unsafe and dangerous manner or in contravention of the Zoning Ordinance. Such Stop Work Order shall be in the form of a red placard bearing the date, Building Permit number (if any), and signature of the Building Administrator or his designee and shall be fastened in place in the immediate vicinity of the Building Permit placard or upon the building or structure which is the subject of the work or anywhere else upon the real property where the work has been undertaken. During the time that a Stop Work Order is in effect, the only activity on the entire job site shall be in connection with removing, repairing or correcting the work which has been disapproved. Further construction work may continue only after the Building Administrator or his designee has withdrawn the Stop Work Order by removal of the red Stop Work Order card and by either a notation on the Building Permit card (if any) or other written notice to the contractor. Such Stop Work Order shall remain in effect until it is removed by the Building Administrator or his designee.
R. Negligence: Inspections by the Building Administrator are in addition to inspections by the owner, architect, contractor, mortgagor and their agents and employees. Approval by the Building Administrator shall not absolve others of their negligence nor be made a defense of the negligence of others.
S. Appeals: Appeal of any order or decision involving an interpretation of a provision or provisions of this Building Code by the Building Administrator shall be written in triplicate, to the Village Clerk for transmission to the Building Code Board of Appeals, who will hear and decide the appeal.
