Penalty for violation of city policy: employees who violate the smoke-free policy of the city shall be subject to discipline up to and including termination. Discipline shall be imposed on a progressive basis as follows:
First offense: Verbal warning
Second offense: Written reprimand and referral to EAP
Third offense: Three-day suspension and a referral to EAP
Fourth offense: Ten-day suspension and a referral to EAP
Fifth offense: Termination
