It is incumbent that during the term of a franchise, a franchisee shall construct, maintain, and operate a cable system that is at a level that reflects the current technology utilized within the industry. In designing and installing a new or rebuilt system, the franchisee shall employ facilities that are consistent with then current state-of-the-art technology and are reasonably capable of being upgraded in the future to accommodate anticipated improvements and new services.
