(A) Except as otherwise provided under this section, the lawful operating hours for each person, firm or corporation licensed under this chapter for the retail package sales or on- premises sale and consumption of distilled spirits, wine and malt beverages shall be Monday through Saturday from 6:00 a.m. until 1:00 a.m. on the following day.
(B) Package sales are prohibited on Sundays.
(C) The sale of distilled spirits, wine, and malt beverages by the drink shall be permitted on Sundays from 12:00 noon until 11:00 p.m. for hotels, restaurants, bed and breakfasts, caterer retailers, and clubs which are licensed for the retail sale of distilled spirits, wine, and malt beverages by the drink; provided such hotel, restaurant, bed and breakfast, caterer retailer, or club satisfies the following conditions:
(1) The hotel, restaurant, bed and breakfast, caterer retailer, or club has a dining facility; including a kitchen approved and operated in accordance with applicable department of health regulations and maintains at least one person licensed as a food handler by the Local or State Department of Public Health on site while open;
(2) The dining facility at the hotel, restaurant or club or place where the catered event occurs has a minimum seating capacity of 50 people at tables. Bed and breakfasts shall be exempted from this condition;
(3) At least 50% or more of the gross annual income from Sunday sales are received from the sale of food or the renting of rooms;
(4) The purchase of distilled spirits, wine and malt beverages by the drink shall also be accompanied by the purchase of food; and
(5) The licensee shall apply for and receive a Sunday sales license and pay the applicable Sunday sale license fee.
(6) The licensee shall only be permitted to sell such type of alcoholic beverage for which it is licensed.
(D) “Last call” shall occur at 12:30 a.m. Monday through Saturday and at 10:30 p.m. on Sunday for those licensees holding a Sunday sales license. No customer shall be admitted into the premises after the designated “last call” time. The licensee shall insure that at the closing hour all patrons shall have vacated the premises. Operators and their employees engaged in regular and ordinary post closing activities may be on the premises up to two hours after closing hours or one hour prior to opening hours.
(E) Licensees, operators, and employees shall not consume any alcoholic beverages on the premises after closing hours.
(F) The Local Liquor Control Commissioner shall have authority to extend “last call” until 1:30 a.m. and the closing hour until 2:00 a.m. for New Year’s Eve or any special event upon written request of a licensee.
