§ 70.03 SOLICITATION OF CONTRIBUTIONS.
   (A)   No person shall stand on a highway or street withing the city for the purpose of soliciting contributions from the occupant of any vehicle except in accordance with this section. Solicitation on highways and streets within this city shall be allowed only at intersections where all traffic is required to come to a full stop.
   (B)   Any person engaged in the act of solicitation shall be 16 years of age or more and shall be wearing a high visibility vest. Also, the soliciting agency shall be liable for any injuries to any person or property during the solicitation which is causally related to an act or ordinary negligence of the soliciting agency.
   (C)   If such solicitation is to be on a state highway, the soliciting agency shall be:
      (1)   Registered with the Attorney General of the State of Illinois as a charitable organization as provided by “an act to regulate the solicitation and collection of funds for charitable purposes, providing for violations thereof, and making appropriation therefor.”
      (2)   Engaged in state-wide fund raising activity.
   (D)   Prior to commencement of any such act of solicitation, the soliciting agency shall complete a written application for permission from the city to do so, upon a form to be furnished by the Mayor. The granting of permission shall be within the sole discretion of the Mayor, who shall also be responsible for the scheduling of the days, times, and locations that such permission or permit shall be effective, There shall be no fee for such permit January 22, 2007
   (E)   Every person who is convicted of a violation of this section shall be fined and/or incarcerated in accordance with the general penalty provisions provided by the city code.
