§ 53.16 WATER SERVICE RATES AND TAP-ON FEES FOR METERED INDUSTRIAL, COMMERCIAL, OR NON-RESIDENTIAL WATER USERS.
   (A)   Definitions. For purposes of this section, the following definitions shall apply unless the context clearly indicates or requires a different meaning:
      COMMERCIAL USER. This classification shall be for business establishments, including without limitation, all retail businesses, offices, quasi-governmental facilities, schools, government offices, multiple-unit dwellings, rooming houses, group houses or shelters, hospitals, hair styling salons, hotels, motels, restaurants, taverns, car washes, coin-operated laundries, commercial laundries, wholesale distributors, trucking firms, assisted living facilities, skilled nursing facilities, intermediate or shelter care nursing facilities, bed & breakfasts, hospitals, clinics, professional offices, grocery stores, supermarkets, convenience stores, gasoline service stations, banks, finance companies, florists, vehicle sales or repair or any and all other types of businesses, commercial enterprises or service facilities.
      INDUSTRIAL USER. This classification shall be for those users or establishments classified as and using the industrial electric rates of the city or designated as industrial by the water department or any utility.
      RESIDENTIAL CLASSIFICATION. This classification shall be reserved strictly single-family dwellings.
      NON-RESIDENTIAL CLASSIFICATION. This classification shall be for any user other than a user that is classified as residential.
   (B)   Requirements for installation of meters. All commercial, industrial or non-residential buildings constructed after the effective date of this section and any commercial, industrial, or non-residential building that is substantially remodeled after the effective date of this section shall be equipped with an approved metering device for purposes of determining the quantity of a water provided by the city to such user. It shall be a precondition to the issuance of a building permit for purposes of construction or remodeling that the permittee shall grant the City of Metropolis any and all necessary easements for purposes of installing, replacing, maintaining and operating water meters upon the premises of the permittee. No utilities shall be provided to any commercial, industrial or non-residential user constructed or substantial remodeled hereafter until such time as such user shall have paid an appropriate tap fee and had a water meter installed. A building shall be considered “substantially remodeled” anytime a building permit is required to be issued in connection with work performed on the building.
   (C)   Metered rates. Unless otherwise agreed in a redevelopment agreement, private development agreement, or similar written contact between the city and developer, all commercial, industrial, or non-residential users of water shall from and after the time water meters are installed pay for water usage at the following rates:

      (1)   In any and all events there shall be a minimum charge equal to $15.00 per month.
      (2)   In any and all events the total charge for 6,000 gallons of water usage shall be equivalent to the non-metered water rate then in effect for residential customers. Any subsequent increase in the non-metered water rates for residential customers shall automatically cause a proportionate increase in the metered water rates for the first 6,000 gallons of water used per month.
   (D)   Tap-on and meter-setting fees.
      (1)   Tap-on fees for one-inch residential service (non-metered) and tap-on and meter-setting fees for commercial, industrial, and nonresidential users shall be in the amounts hereinafter set forth, depending upon the size and service requested:

      (2)   The water tap-on fees and meter-setting fees set forth above shall be increased annually in January by an amount equivalent to the increase in the consumer price index for the previous year as published by the U.S. Department of Labor, Bureau of Labor Statistics. The consumer price index, all items for the month of December 2022, shall be deemed the base index for purposes of calculating increases. The first increase in the charges established in division (D)(1) above shall occur on or after January 1, 2024.
      (3)   It shall be the responsibility of each prospective user to properly size its water service and to accurately report the same to the city. The city shall not be responsible for an inaccurate or inappropriate size of service or any damages resulting therefrom.
