(A) (1) A permitted non-highway vehicle may be operated only on roadways of the city where the posted speed limit is 35 miles per hour or less.
(2) This division (A) does not prohibit a permitted non-highway vehicle from crossing a roadway at an intersection where the roadway being crossed has a posted speed limit of more than 35 miles per hour.
(B) A person may not operate a permitted non-highway vehicle upon any roadway of the city unless he or she has attained the age of 18 years and has a valid driver's license issued in his or her name by the Secretary of State of Illinois, or by the drivers licensing authority of another state of the United States of America.
(C) No permitted non-highway vehicle may be operated on any roadway of the city, unless at a minimum it is equipped with the following:
(1) Brakes;
(2) A steering apparatus;
(3) Tires;
(4) A rearview mirror;
(5) Reflectorized warning devices in the front and rear;
(6) A slow moving emblem (as required of other vehicles in ILCS Ch. 625, Act 5, § 12-709) on the rear of the non-highway vehicle;
(7) A headlight that emits a white light visible from a distance of 500 feet to the front;
(8) A tail lamp that emits a red light visible from at least 100 feet from the rear;
(9) Brake lights; and
(10) Turn signals.
(D) No permitted non-highway vehicle may be operated on any roadway of the city, except when its headlight and tail lamp are lighted as required by § 12-201 of the Illinois Vehicle Code (ILCS Ch. 625, Act 5, 12-201), as now or hereafter amended.
(E) A person who drives or is in actual physical control of a permitted non-highway vehicle on any roadway of the city shall operate such vehicle in compliance with all the requirements Chapter 11, entitled "Rules of the Road," of the Illinois Vehicle Code (ILCS Ch. 625, Act 5, §§ 11-100 et seq.), as now or hereafter amended.
(F) A person who drives or is in actual physical control of a permitted non-highway vehicle on any roadway of the city while under the influence is subject to §§ 11-500 through 11-502 of the Illinois Vehicle Code (ILCS Ch. 625, Act 5, §§ 11-500 through 11-502), as now or hereafter amended.
(G) A person who operates a permitted non-highway vehicle on any roadway of the city shall be subject to the mandatory insurance requirements under Article VI of Chapter 7 of the Illinois Vehicle Code (ILCS Ch. 625, Act 5, §§ 7-601 et seq.), as now or hereafter amended.
(H) No owner of a permitted non-highway vehicle shall allow such vehicle to be operated on any roadway of the city except in compliance with this chapter.
(I) No person shall operate a permitted non-highway vehicle on any of the following:
(1) Any recreational bike or walking trail unless the trail is specifically designated for the use of motor vehicles; and
(2) Sidewalks of the city; and
(3) City parks or any other land owned by the city; unless written permission is granted by the City Council; and
(4) Private property within the city without the prior written consent of the property owner; and
(5) On US Highway 45 (including 10th Street, Ferry Street, and 5th Street), Devers Road, and Old Marion Road in the city; provided however, that permitted non-highway vehicles may cross these streets at an intersection and at approximately a 90-degree angle after coming to a complete stop and yielding right-of-way to cross traffic.
(J) Except when executing a left turn, permitted non-highway vehicles shall be driven as close as practical to the right-hand curb or edge of any street or alley in the city. When necessary to prevent congestion of traffic, permitted non-highway vehicles shall be pulled to the right-hand edge of streets and stopped in order to allow other motor vehicles traveling in the same direction to pass. When two or more permitted non-highway vehicles are being operated on the same street or alley and in the same direction, they shall proceed strictly in single file.
(K) Permitted non-highway vehicle may be parked on city streets or in city parking lots only in designated parking spaces.
(L) No person shall operate a permitted non-highway vehicle with more passengers than the seating capacity of the vehicle.
(M) No person shall operate a permitted non-highway vehicle on any roadway adjacent to a public school on any day when children are in attendance.
