§ 53.008 ENFORCEMENT - VIOLATION BY AN EMPLOYEE.
   (A)   Upon receipt of a written, signed and notarized complaint alleging that an employee other than the Executive Director violated this chapter, the Executive Director shall direct the general counsel to appoint counsel to investigate and report on the alleged violation to the Executive Director. The investigating counsel shall determine if, based upon the evidence, there is probable cause that a violation has occurred.
   (B)   If prosecution is warranted and/or the internal disciplinary process should be initiated after reviewing the report, the Executive Director shall direct the general counsel to:
      (1)   Contact the attorney general or the state’s attorney for prosecution;
      (2)   If necessary, appoint special counsel to prosecute the manner judicially; and/or
      (3)   Recommend the matter for handling by the appropriate internal disciplinary process.
