(a) Effective January 1, 2017, the operation of golf carts is permitted on the City roadways having an established speed limit not greater than 35 miles per hour, provided that the operator has complied with all other State laws regarding the operation of a golf cart on the City roadways.
(b) This section does not prohibit a person operating a golf cart from proceeding across an intersection of a street or highway having a speed limit greater than 35 miles per hour.
(c) A vehicle owner who wishes to operate a golf cart on the public streets or highways of the City must submit the vehicle to an inspection conducted by a local law enforcement agency that complies with inspection requirements established by the Department of Public Safety under Ohio R.C. 4513.02.
(d) A vehicle owner who wishes to operate a golf cart on the public streets or highways of the City must register the golf cart in accordance with Ohio R.C. Chapter 4503, and have it titled in accordance with Ohio R.C. Chapter 4505.
(e) Except as otherwise provided in this section, whoever violates division (a) of this section is guilty of a minor misdemeanor. If within one year of the offense, the offender previously has been convicted of or pleaded guilty to one predicate motor vehicle or traffic offense, whoever violates this section is guilty of a misdemeanor of the fourth degree. If within one year of the offense, the offender previously has been convicted of two or more predicate motor vehicle or traffic offenses, whoever violates this section is guilty of a misdemeanor of the third degree.
(f) The Police Chief prior to January 1, 2017 shall notify the Ohio Director of Public Safety, in a manner that the Director determines, of the authorization for the operation of under-speed or utility vehicles or mini-trucks.
(g) The Police Chief and the Mentor on the Lake Police Department have the right but not the obligation to conduct golf cart inspections pursuant to the requirements of division (c) of this section and pursuant to Ohio R.C. 4513.02. The Police Chief shall determine whether or not the Mentor on the Lake Police Department will conduct these inspections and if the Department is conducting these inspections, then the Department shall charge a fee of $10.00 to residents of Mentor on the Lake and $20.00 for non-residents of Mentor on the Lake.
