(a) Unless otherwise provided, whoever violates or fails to comply with any of the provisions of this chapter, including the provisions of the Ohio Fire Code adopted in Section 1610.01, and including any order of the fire official or his authorized representative made pursuant thereto, or builds in violation of any detailed statement of specifications or plans submitted and approved thereunder, or any certificate or permit issued thereunder, and from which no appeal has been taken, or fails to comply with such an order as affirmed or modified as provided in this chapter, within the specified time, is guilty of a minor misdemeanor for a first offense and shall be fined not more than one hundred fifty dollars ($150.00). For a second and subsequent offense, such person is guilty of a misdemeanor of the first degree and shall be fined not more than one thousand dollars ($1,000) or imprisoned not more than six months, or both. The imposition of one penalty for any violation shall not excuse the violation or permit it to continue, and all such persons shall be required to correct or remedy such violations or defects within a reasonable time. When not otherwise specified, a separate offense shall be deemed committed each day that prohibited conditions are maintained or permitted to exist after due notice has been served in accordance with the provisions of the Ohio Fire Code or with applicable law.
(b) The application of the penalty provided in subsection (a) hereof shall not be held to prevent the enforced removal of prohibited conditions.
