1462.99   PENALTY; EQUITABLE REMEDIES.
   (a)   Whoever violates any provision of this chapter is guilty of a minor misdemeanor for a first offense and shall be fined not more than one hundred dollars ($100.00). For a second or subsequent offense, such person shall be guilty of a misdemeanor of the first degree and shall be fined not more than one thousand dollars ($1,000) or imprisoned not more than six months, or both, for each offense. A separate offense shall be deemed committed each day during or on which a violation or noncompliance occurs or continues after due notice has been served, in accordance with the terms and provisions of this chapter or with other applicable law.
   (b)   The imposition of any penalty, as provided in subsection (a) hereof, shall not preclude the Law Director from instituting an appropriate action or proceeding in a court of proper jurisdiction to prevent an unlawful repair or maintenance; to restrain, correct or abate a violation; to prevent the occupancy of a building, structure or premises; or to require compliance with the provisions of this chapter or other applicable laws, ordinances, rules or regulations, or the orders or determinations of the Zoning Inspector or a duly designated representative, the Mayor, the Administrative Director, the Board of Zoning Appeals or the Planning Commission.
