(a) Any pool requiring a permit under the provisions of this chapter shall have a fence around such pool, such as a snow fence, forty-two inches to seventy-two inches in height. Such fence shall have a gate which can be locked and shall be constructed so as to prevent access to such pool by small children. No person shall fail to provide and maintain such fence or gate. If the yard is completely fenced in with a locking gate, no fence around such pool shall be required.
(b) The gate in the fence required in subsection (a) hereof shall be kept locked so that the same may not be opened without a key. A pool cover may provide supplementary protection, but shall not be considered as a substitute for a fence.
