(a) Any person or entity that conducts a public fireworks exhibition shall apply for a permit from the City to conduct such an exhibition. A certified fire safety inspector, the Fire Chief or Fire Prevention Officer shall be present before, during and after the exhibition. The person or entity that conducts a public fireworks exhibition shall have a certified fire safety inspector, the Fire Chief or Fire Prevention Officer inspect the premises where the exhibition is to take place and determine whether the exhibition is in compliance with Section 672.10 of these Codified Ordinances and Ohio R.C. Chapter 3743. No permit shall be issued unless the fee that is specified below is paid to the City.
(b) The fee for a permit to conduct a public fire works exhibition is as follows:
(1) One thousand dollars ($1,000) if the person or entity that conducts a public fireworks exhibition requests the Fire Chief or the Fire Prevention Officer to be present before, during and after the exhibition. The Fire Chief or the Fire Prevention Officer will also inspect the premises where the exhibition is to take place and determine whether the exhibition is in compliance with this section, Section 672.10 and R.C. Chapter 3743 as part of this one thousand dollar ($1,000) permit fee.
(2) One hundred dollars ($100.00) if the person or entity that conducts a public fireworks exhibition employs a certified fire safety inspector to be present before during and after the exhibition and if the person or entity that conducts a public fireworks exhibition has a certified fire safety inspector inspect the premises where the exhibition is to take place and determine whether the exhibition is in compliance with this section, Section 672.10 of these Codified Ordinances and Ohio R.C. Chapter 3743.
(c) Whoever violates any provisions of this section is guilty of a misdemeanor of the first degree.
