452.99 PENALTY.

   (a)   Penalties for violations of Sections 452.01, 452.03(a) to (q), 452.06, 452.08, 452.09, 452.10, 452.11 and 452.17 shall be as follows:

      (1)   The first offense: ten dollars ($10.00);

      (2)   The second offense within 12 months: twenty-five dollars ($25.00);

      (3)   The third and all subsequent offenses within 12 months of the second offense shall be a minor misdemeanor and the penalty therefor shall be as provided in Section 408.01.

   (b)   Penalties for violations of Section 452.03(s) and 452.16 shall be as follows:

      (1)   For the first offense, one hundred dollars ($100.00);

      (2)   For the second offense occurring within 12 months of the first offense, two hundred and fifty dollars ($250.00); and

      (3)   For the third and all subsequent offenses occurring within 12 months of the second offense, a minor misdemeanor, punishable by a fine of not more than five hundred dollars ($500.00).

   (c)   The above fines for a first and second offense shall be waiverable as provided for in Section 452.15.
