446.10 PERSONS UNDER THE INFLUENCE OF INTOXICATING LIQUOR OR NARCOTIC DRUGS.

(b) No person who is under the influence of intoxicating liquor or narcotic drugs or opiates shall be in actual physical control of any motor vehicle.

(c) Whoever violates division (a) of this section is guilty of a misdemeanor of the first degree. Whoever violates division (b) of this section is guilty of a misdemeanor of the second degree. The penalty shall be as provided in Section 408.01.
