4-8-5: PROHIBITION OF SMOKING IN SPECIFIED OUTDOOR AREAS:
   A.   Smoking is prohibited within a reasonable distance of: 1) all outside entrances to; 2) operable windows of; and/or 3) a ventilation system of, those public places or places of employment where smoking is prohibited pursuant to sections 4-8-3 and 4-8-4 of this chapter so as to prevent smoke from entering those public places or places of employment where smoking is prohibited. This prohibition shall only apply to public property under the city's jurisdiction, e.g., city streets or alleys, city sidewalks or other property under the city's jurisdiction.
   B.   The person in charge of a restaurant, tavern, private club or retail establishment may designate an outside area that is a reasonable distance from any entrance to the restaurant, tavern, private club or retail establishment where customers, employees or persons associated with the restaurant, tavern, private club or retail establishment may smoke. This designation shall not be permitted to include city streets and alleys, city sidewalks or other public property under the city's jurisdiction. (Ord. 2010-06, 6-21-2010, eff. 7-5-2010)
