2-9-6: PUBLIC NUISANCE ABATEMENT:
   A.   Public Nuisance: No person, firm or corporation shall permit any public nuisances as defined in section 2-9-3 of this chapter to occur on any property. The following are specifically declared public nuisances wherever they may be found within the city:
      1.   Any elm tree or part thereof described in title 4, chapter 4 of this code.
      2.   Any living or standing oak tree or part thereof infected with oak wilt disease. Any dead oak tree or parts thereof, including logs, branches, stumps, firewood or other oak material from which the bark has not been removed and burned, chipped, buried or otherwise treated to stop oak wilt.
      3.   Any living or standing ash tree or part thereof infected with emerald ash borer or beetle. Any dead ash tree or parts thereof, including logs, branches, stumps, firewood or other ash material from which the bark has not been removed and burned, chipped or otherwise treated to destroy or prevent the infestation of the emerald ash borer beetle.
      4.   Any hedge, tree, shrub or growth which extends into the "vision triangle" as defined in subsection 10-4-5G of this code.
      5.   Any living or standing female amur cork tree.
      6.   Any hedge, tree or shrub listed in NR 40.04(2)b.
   B.   Abatement: The procedure for abatement of the public nuisances referenced in subsection A of this section shall be as set forth in title 4, chapter 4 of this code. (Ord. 2023-11, 4-3-2023)
