2-9-3: DEFINITIONS:
In this chapter, unless the context clearly requires otherwise, the following words and terms shall be defined as follows:
 
BOULEVARD:
If there is no sidewalk present, then the boulevard area is that portion of street right-of-way lying between the property line and the edge of the traveled portion of the street, which may be delineated by curbing if the street is improved, or in the absence of curbing, may be the edge of a gravel or an asphalt surface.
If sidewalk does exist, then the boulevard is that portion of street right-of-way lying between the edge of the sidewalk and the edge of the traveled street as defined above.
CITY FORESTER:
A.   Appointment. The Urban Forestry Board may employ a City Forester, who shall be the city public works director or their designee (§ 27.09, Wis. Stats.)
B.   Powers and Duties. The City Forester shall have the following general powers and duties:
1. To direct, manage, supervise, and control the City street program to include all planting, removal, maintenance, and protection of all trees and shrubs on all public areas; to supervise park department personnel in the planting, removal, maintenance, and protection of said trees and shrubs.
2. To guard all trees and shrubs within the City so as to prevent the spread of disease or pests and to eliminate dangerous conditions which may affect the life, health, or safety of persons or property.
3. Such other powers and duties as are provided by the laws of Wisconsin, particularly Wis. Stats. §§ 27.08 and 27.09; by ordinances of the City, and by the Urban Forestry Board.
PARK:
All public parks, playgrounds, waterfront, buffer areas, beaches and leisure time areas having individual names.
PUBLIC NUISANCE:
Any tree or shrub on public or private property which is specifically designated as a public nuisance in this chapter which by reason of its condition: a) interferes with the use of any public place; b) is infected with an injurious plant disease, or is infested with an injurious insect or other pest, or serves as host to obnoxious or undesirable insects or other pests; c) has excessive fruit production, or is malodorous, or exhibits an aggressive reproductive nature; d) is detrimental to the construction of public improvements; or e) endangers the life, health, safety or welfare of the public or its property.
PUBLIC TREES AND SHRUBS:
Any tree or shrub located within public right-of-way or other lands owned or leased by the city.
URBAN FORESTRY:
Urban Forestry is the care and management of single trees and tree populations in urban settings for the purpose of improving the urban environment. (Ord. 2023-11, 4-3-2023)
