11-2-2: MEANING OF TERMS OR WORDS/DEFINITIONS:
The following terms or words for purposes of this title shall have the meanings herein provided unless the context within which the word or term appears clearly requires otherwise:
ADMINISTRATIVE LOT SPLIT:
Is a division of a single tract or parcel into no more than two (2) parcels for the purpose of conveyance or development.
APPLICANT:
An applicant may be an individual, firm, corporation, limited liability company, partnership, association, syndicate, trust or other legal entity that executes and submits an application and initiates proceedings before the city in accordance with the provisions of this title. The applicant must be the owner of the property at issue in the application, or be authorized in writing by the owner of the real property at issue, in order to submit the application. Upon request, the applicant must demonstrate it has authority to submit an application for the subject real property. The term applicant may also include a subsequent owner of property if the property subject to the application is transferred to a new owner: (1) during the application process; (2) before or while improvements are being constructed; (3) or before a bond is posted in lieu of improvements construction.
BLOCK:
A group of lots, tracts or parcels within a well-defined boundary, usually streets.
BUILDING SETBACK LINE:
An imaginary line established by a zoning ordinance that requires all buildings to be set back a certain distance from lot lines.
CHIP SEALING:
The process of applying upon asphalt surfaced road and/or street an oil product to act as an adhesive and clean crushed rock for the purpose of maintaining the functional integrity of the asphalt surface of the road and/or street.
CITY CLERK:
The duly appointed city clerk who serves as a city officer as otherwise provided for in the Melba city code.
CITY ENGINEER:
The licensed engineer, or engineering company, duly appointed by the council that serves as city engineer for the city of Melba.
COMMISSION:
The Melba planning and zoning commission, appointed by the mayor and confirmed by the council.
COMPREHENSIVE PLAN:
A document adopted by the city that may be referred to herein as a comp plan that identifies previous and existing conditions, trends, and compatibility of current and proposed land uses, as well as desirable goals and objectives, or desirable future situations for the city.
COUNCIL:
The city council of the city of Melba.
COVENANT:
A written promise or pledge.
CULVERT:
A drain that channels water under a bridge, street, road or driveway.
DEDICATION:
The setting apart of land, improvements, or interests in land for use by the public by ordinance, resolution or entry in the official minutes as by recording of a plat. Dedicated property becomes public upon acceptance by the city.
EASEMENT:
A grant of rights(s) by a property owner to specific persons, entities, or the public to use certain land for specific purposes.
FINAL PLAT:
A map of all or part of a subdivision providing substantial conformance to an approved preliminary plat, prepared and stamped by a registered land surveyor in accordance with the standards of this title and chapter 13 of title 50, Idaho code, which can be recorded after compliance with the provisions of this title.
IMPROVEMENTS:
Means and refers-but is not necessarily limited to-survey monuments, streets, alleys, curbs, gutters, bicycle pathways, public utilities, driveways, storm drainage, public water systems, sewer systems, fire hydrants, water mains, wells, streets signs, sidewalks, pedestrian pathways, street lighting, irrigation systems, landscaping buffers, and potential other fixtures that may be installed or constructed upon real property.
ISPWC:
The latest edition of the Idaho standards for public works construction as adopted by the city.
LOT:
A parcel, plot, tract or other land area of suitable size as required in these regulations and by the zoning ordinance of the city of Melba, and created by subdivision for sale, transfer or lease.
LOT LINE ADJUSTMENT:
An adjustment or change to the location of boundary lines between no more than four (4) parcels of land. An adjustment may involve removing the boundary lines between parcels and consolidating the parcels into fewer parcels, or relocating the boundary lines but maintaining the current number of parcels. A lot line adjustment cannot increase the number of lots or parcels.
MANUFACTURED HOME:
As defined in the Melba city code under the manufactured housing regulations.
MINOR SUBDIVISION:
The division of a platted lot or a parcel of land into four (4) or fewer contiguous lots that comply with minimum standards of the zoning ordinance in all respects, that have access onto an existing public right of way or an approved shared driveway that serves no more than two (2) of the four (4) proposed lots and complies with applicable fire codes.
OFF-SITE:
Not located on the property that is the subject of a development application.
ON-SITE:
Located on the land in question.
OPEN SPACE:
A common area platted as a separate lot, exclusive of streets, commercial and residential buildings, and shall be designated and intended as a usable and convenient amenity for the residences of any proposed development.
ORIGINAL PARCEL OF LAND:
A lot or tract as recorded on any plat or record on file in the office of the county recorder, or any un-platted contiguous parcel of land held in one ownership and of record at the effective date of the subdivision ordinance.
PERFORMANCE BOND:
An amount of money or other negotiable security paid by the applicant or his surety to the city which guarantees that the applicant will perform all action required by the governing body regarding an approved plat.
PLANNED UNIT DEVELOPMENT:
A process for legally dividing land set forth in chapter 5 of title 10, Melba city code that may be available to an applicant in lieu of the applications available in this title.
PLAT:
The drawing, map or plan of a subdivision, cemetery, townsite or other tract of land, or a re-platting of such, including certifications, descriptions and approvals.
PRELIMINARY PLAT:
A preliminary map, including supporting data, indicating a proposed subdivision development, prepared in accordance with the standards of this title, title 10 of the Melba city code, and chapter 13 of title 50, Idaho Code.
RESERVE STRIP:
A strip of land between a partial street and adjacent property, which is reserved or held in public ownership for future street extension or widening.
STREET:
A right of way which provides access to adjacent properties, the dedication of which has been officially accepted by the city. The term "street" also includes the terms highway, thoroughfare, parkway, road, avenue, boulevard, lane, place and other such terms. Types of streets include the following:
   Alley:
A minor street providing secondary access at the back or side of a property otherwise abutting a street. Minimum right of way width of twenty feet (20').
   Arterial:
A street that is designed and intended to accommodate vehicle traffic between two (2) major population bases.
   Collector Street:
A street designated for the purpose of carrying traffic from minor streets to other collector streets and/or arterial streets.
   Cul-De-Sac:
A street connected to another street at one end only and provided with a turnaround space at its terminus.
   Frontage:
A minor street, parallel and adjacent to an arterial street, to provide access to abutting properties.
   Loop:
A minor street with both terminal points on the same street of origin.
   Minor Street:
A street which has the primary purpose of providing access to abutting properties.
   Partial:
A dedicated right of way providing only a portion of the required street width, usually along the edge of a subdivision or tract of land.
SUBDIVISION:
The act of dividing a single tract or parcel of land into two (2) or more lots, parcels, or sites for the purpose of sale or development, whether immediate or future.
SURVEYOR:
Any person who is licensed in the state of Idaho as a land surveyor to do professional land surveying.
UTILITIES:
Any of the following public works construction for domestic water, irrigation water, sewage, gas, electricity, television cable, storm water and appurtenances and/or any similar facilities providing service to, intended to be used by the public.
VARIANCE:
A permit for relief from the strict terms of the relevant regulations of this title where such relief will not be contrary to the public interest and where the need for relief is due to peculiar conditions or characteristics of the property and not the result of the actions of the applicant. A variance shall not be considered a right or special privilege but may be granted only upon a showing that a literal enforcement of this title would result in undue hardship. (Ord. 276, 10-11-2021)
