ORDINANCE NO.  _271__
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF MELBA, CANYON COUNTY, STATE OF IDAHO, MAKING CERTAIN FINDINGS; AMENDING MELBA CITY CODE SUBSECTION (E) OF SECTION 7 OF CHAPTER 2 OF TITLE 8; PROVIDING REQUIREMENTS FOR CONNECTION TO CITY SEWER; AND PROVIDING AN EFFECTIVE DATE.
NOW, THEREFORE, BE IT ORDAINED by the Mayor and City Council of the City of Melba, Canyon County, Idaho:
SECTION 1:  Amending 8-2-7 (E) of Melba City Code:
That Subsection E of Section 7 Chapter 2 Title 8 Melba City Code be and the same is hereby amended to read as follows:
E. Connection to Sewer System Required:
1. The owner of any building occupied by humans situated within the city and abutting on any street in which there is now located or may in the future be located a public sewer of the city is hereby required at his expense to connect said building directly with the proper public sewer in accordance with the provisions of this chapter within ninety (90) days after date of official notice to do so; provided, that said public sewer is within one hundred feet (100') of the nearest point of the building.three hundred feet (300’) of the nearest point of the property boundary Once public sewer connection has been established to a property, any additional buildings occupied by humans on the same property by the same owner shall also connect to public sewer regardless of distance to the sewer connection.
 
2. Commercial, industrial and public buildings or institutions shall be required to connect to the city sewer system upon notice as herein provided. For public buildings with limited or seasonal use up to a maximum of three months a year, the requirement for connection to city sewer will be determined by city council on a case by case basis dependent on traffic, usage of the facility and nitrate levels in the water.
 
3. The further maintenance or use of cesspools or other local means of sewage disposal constitutes a public nuisance. All buildings inhabited or used by human beings which the property boundary is withinone hundred feet (100')three hundred feet (300’) of the sewerage system of the city or any extension hereafter made thereto, and in which any sewage is produced shall be connected with the sewerage system of the city within ninety (90) days from completion thereof.
 
SECTION 2: Date of Effect
 
   This ordinance shall be in full force and effect upon its passage, approval and publication, according to law.
