§ 5.28.260 EDUCATION AND GOVERNMENTAL PROGRAMMING.
   A.   A Grantee shall provide, at no charge, one channel for educational and governmental cablecasting to be provided upon request by the County. Such channel may be shared with neighboring units of local government upon request by the Grantee and agreement of the County.
   B.   A Grantee shall provide such channel for education and governmental (“EG”) access as follows:
      1.   The EG channel shall be offered as a part of the Basic Cable Service and shall be located within the first 40 channels of the Cable System;
      2.   The EG channel shall be offered as part of Basic Cable Service. A Grantee shall not use this channel without permission of the County;
      3.   Such channel shall be available 24 hours per day, at no cost to Subscribers;
      4.   A Grantee shall not have any editorial control of the content of any EG channel; and
      5.   The County shall have full control and responsibility over the allocation of programming on the EG channel and time slots and on each channel.
   C.   To the extent that a Grantee’s Cable System possesses excess Leased Capacity which is not providing programming to Residents, the Grantee shall notify the County of same and permit the County to utilize such excess Leased Capacity at no charge for purposes of cablecasting.
