If said owner allows said code to exist or fails to abate said violation he or she, upon conviction thereof, shall be fined not less than $25, nor more than $500 for each offense or be imprisoned in the county jail for a period not exceeding one year, or be both fined and imprisoned. A separate offense shall be deemed committed on each day during or one, which such violation is permitted to exist.
