§ 35.06 PER DIEM FEES; OUT-OF-COUNTY PRISONERS.
   (A)   A per diem fee per prisoner will be negotiated for all out-of-county prisoners incarcerated in the county regional jail with said fee to be determined by contract between Fiscal Court and the contracting county’s Fiscal Court.
   (B)   The transferring county wishing to lodge a prisoner in the county jail must first have the permission of the county jailer and must be responsible for the transporting of the prisoner to and from the county regional jail.
   (C)   The transferring county shall remain fully responsible for any special or unusual expenses incurred by the county in housing their prisoner or prisoners, including, but not limited to, medical, dental and hospital treatment, as well as for the repair of or replacement of any property destroyed by said prisoner.
   (D) The transferring county shall immediately pick up and remove the prisoner from the county regional jail upon notification by the county jailer.
   (E)   The county jailer shall have complete authority in acceptance, supervision and removal of any out-of-county prisoners.
   (F)   All fees and expenses claimed owing to the county are payable within 30 days of presentation of a bill from the County Fiscal Court to the Fiscal Court of the county of the prisoner’s origin.
   (G)   This section shall apply only to prisoners who have attained the age of at least 18 years.
   (H)   The effective date of this section shall be November 25, 1991.
