(A) Upon receiving the notice to repair or demolish the building, the owner of the building, within ten days of the receipt of the notice, may in writing to the City Clerk request a hearing before the Building and Housing Code Advisory and Appeals Board, to present reasons why the building should not be repaired or demolished. The Building and Housing Code Advisory and Appeals Board shall grant the hearing within ten days from the date of receiving the request. A written notice of the Building and Housing Code Advisory and Appeals Board's decision following the hearing shall be sent to the property owner by certified mail. If the Building and Housing Code Advisory and Appeals Board rejects the appeal, the owner shall have 60 days from the sending of the decision to remedy the condition or demolish the building. If, after the 60-day period, the owner has not remedied the condition or demolished the building, the Building Inspector shall proceed to cause the work to be done.
(B) The property owner may appeal the decision of the Building and Housing Code Advisory and Appeals Board to the City Council if done in writing within seven days of the receipt of the decision of the Building and Housing Code Advisory and Appeals Board by filing the same with the City Clerk. A hearing shall be held before the City Council within ten days of the receipt of the notice of appeal by the property owner. Written notice of the City Council's decision following the hearing shall be sent to the property owner by certified mail.
(C) If the City Council rejects the appeal of the property owner, the owner shall have 60 days from the sending of the decision to remedy the condition or demolish the building. If, after the 60- day period, the owner has not remedied the condition or demolished the building, the Building Inspector shall proceed to cause the work to be done.
(D) The property owner may appeal the decision to the appropriate court for adjudication during which proceedings the decision of the City Council shall be stayed.
