Imposition of any penalty for a violation of this chapter shall not be construed as a waiver of the right of the city to collect the costs of removal or trimming of the tree in accordance with the provisions of this chapter where it is necessary for the city to remove or trim the tree in accordance with the provisions of this chapter.
